GESTOBRA – Gestão e Serviços Técnicos, SA lodged an ordinary appeal on grounds of unconstitutionality against an order of the President of the Luanda Court of Appeal confirming that its appeal had lapsed for late payment of costs, invoking effective judicial protection. The Second Chamber allowed the appeal and declared unconstitutional the interpretation of Article 127(3) and Article 149 of the Code of Court Costs, as the payment period runs only from the court's belated issue of payment slips.
