Constitutional Court

The Constitutional Court is the supreme body of constitutional jurisdiction provided for in the Constitution of the Republic of Angola and has, in general, the task of administering justice in matters of a legal and constitutional nature.

The decisions of the Constitutional Court take the form of judgments, in accordance with the Code of Civil Procedure, the Organic Law of the Constitutional Court and the Constitutional Procedure Law and, on a supplementary basis, with the provisions of its Internal Regulations.

As a court, this institution shares the characteristics common to all superior courts: it is an organ of sovereignty (Articles 105 and 174 of the Constitution of the Republic of Angola); it is autonomous, as it does not operate within any other body; its composition and powers are defined directly in the Constitution; and its judges are independent and irremovable.

The operative part of the judgments, in particular those that assess the unconstitutionality of any provision, is always preceded by the legal and constitutional grounds for the decision. The decisions of the Constitutional Court are binding on all public and private entities and prevail over those of the other courts (including the Supreme Court) and of any other authorities.

Judgments of the Court declaring legal provisions unconstitutional or finding unconstitutional omissions must be published in Series I of the Official Gazette (Diário da República).
