File a document with the Court

Applications to the Constitutional Court are filed with the Court Registry at the Palácio da Justiça. See where to file, what an application must contain and how time limits are counted.

What the application must contain

Make sure your application states:

0 of 6 confirmed. In concrete review proceedings, the application must also meet the requirements of the Code of Civil Procedure.

Appealing a decision of another court?

In that case the application is not filed with the Constitutional Court: it is filed with the court that gave the decision (court of origin).

Step by step

  1. Prepare the application

    Include the elements required by law and attach the supporting documents.

  2. File it with the Court Registry

    Palácio da Justiça, Rua 17 de Setembro, Cidade Alta, Luanda. Check opening hours on (+244) 222 370 877.

  3. Recording

    The Registry records the application and refers it to the President of the Court, as a rule within 24 hours.

  4. Admission

    The President decides whether to admit the application, and may first invite you to correct or complete it.

  5. Notification

    Decisions are notified by the means provided by law, including e-mail.

Costs

Most proceedings before the Constitutional Court are free of costs. The exception is concrete review proceedings (appeals on grounds of unconstitutionality), to which the general rules apply (Law No. 3/08, Art. 15).

Frequently asked questions

What happens if something is missing?
The President of the Court may invite the applicant to correct the application. If it is not corrected, it must be rejected (Law No. 3/08, Arts. 7 and 8).
Do time limits stop during court holidays?
Not in abstract review proceedings. In concrete review proceedings, they do (Law No. 3/08, Art. 14(4)).
Can I file by e-mail?
Ask the Court Registry which filing methods are accepted. The Court’s notifications, however, may be sent by e-mail (Law No. 3/08, Art. 13).
