Structure and Jurisdiction

The Constitutional Court comprises two Chambers with the same subject-matter jurisdiction; others may be created by decision of the Plenary when the caseload so warrants.

Under Articles 46(1) and 65(1) of the Constitutional Procedure Law (LPC), read together, the Chambers have jurisdiction to decide ordinary appeals on grounds of unconstitutionality and to examine the legality of the formation of coalitions of political parties.

One of the Chambers is presided over by the Vice-President of the Constitutional Court and the other by a Justice chosen by the Plenary, for a two-year term of office.

The Chambers are composed of five Justices.

The Justices, including the Vice-President, are assigned to the Chambers by decision of the Plenary, on a proposal from the President of the Court, in accordance with the principle of rotation and avoiding the simultaneous replacement of their members.

The rotation referred to in the preceding paragraph lasts one year and six months.

The President of the Constitutional Court may take part in the sessions of the Chambers, which he or she shall preside over without the right to vote.
