The appellant appealed to the Plenary against an order of the President of the Court rejecting as out of time his complaint against the Luanda Court of Appeal's refusal, also as out of time, to admit an ordinary appeal on grounds of unconstitutionality, alleging breach of access to justice and effective judicial protection. The Court dismissed the appeal because setting procedural time limits is for the legislature and missing them entails forfeiture, without breaching the Constitution.
