Fazenda Mangais, S.A. and another appellant brought an ordinary appeal on grounds of unconstitutionality against an order of the Luanda District Court which, under Article 692(2)(d) of the Code of Civil Procedure, required them to provide security to maintain the suspensive effect of their appeal, invoking the right of appeal and fair proceedings. The Second Chamber dismissed the appeal because the appellants challenged the order's interpretation rather than the constitutionality of the rule applied.
