The appellant appealed against the Supreme Court judgment which, in interim proceedings, upheld the applicant's possession of a plot of land against his disturbance, alleging breaches of fair trial, legality and equality in the assessment of evidence. The Court dismissed the appeal because the interim measure only recognised possession on the basis of an apparent right, title being for the ordinary courts, and giving reasoned preference to one party's evidence does not breach equality.
