The appellant, sentenced to 17 years' imprisonment for homicide and whose criminal appeal was not admitted for failure to file submissions, appealed to the Plenary against the order of the Acting President of the Court rejecting his appeal on grounds of unconstitutionality, invoking effective judicial protection and two levels of jurisdiction. The Court dismissed the appeal because he had not identified the challenged rule and had not exhausted ordinary remedies, notably a complaint to the president of the higher court.
