The appellant appealed to the Plenary against the order of the President of the Constitutional Court rejecting as out of time his extraordinary appeal on grounds of unconstitutionality against a 2008 judgment of the Civil and Administrative Chamber of the Supreme Court, arguing that the eight-day time limit did not apply to such appeals. The Court dismissed the appeal, holding that the right to appeal had lapsed, since the appeal is governed by its own law and the rules on review appeals do not apply by analogy.
