The company Mota e Irmãos, SA lodged an ordinary appeal on grounds of unconstitutionality against the judgment of the Plenary of the Supreme Court upholding the confiscation of its properties, ordered by joint ministerial order on the grounds of its directors' unjustified absence, invoking the right to property and the democratic rule of law. The Court dismissed the appeal, holding that the laws applied were consistent with the constitutional law then in force and that the confiscation met the legal requirements.
