Seven UNITA members brought an action challenging the party's 13th Ordinary Congress, seeking the annulment of the decision setting its date, the electoral rules, a provincial assembly and the Congress itself, invoking equality and non-discrimination. In its reasoning the Court upheld the objection of lis pendens, since an earlier action with the same parties, claim and cause of action was pending, which precluded examination of the merits.
