A citizen asked the Court to declare null the article of the Statutes of the Partido de Renovação Social (PRS) setting a six-year interval for its ordinary congress, alleging that the Fourth Congress had approved a different interval and that the documents sent for registration had been altered. The Court upheld the plea of res judicata and dismissed the claim, as the parties, claim and cause of action matched two earlier cases on the same congress.
