PRIMAR – Consultoria, Engenharia e Comércio (SU), Lda. appealed to the Plenary against an order of the President of the Court dismissing its complaint against the non-admission of an extraordinary appeal on grounds of unconstitutionality from a decision on a motion to recuse the trial judge, invoking the right of appeal. The Court dismissed the appeal because the decision was interlocutory and not open to such an appeal, and that statutory restriction is constitutionally legitimate.
