MACON Transporte, S.A. appealed to the Plenary against the order of the Acting President of the Court rejecting its complaint and refusing to admit its extraordinary appeal on grounds of unconstitutionality concerning a challenge for suspected bias, alleging breach of access to justice and the right of appeal. The Court dismissed the appeal, since the company should have complained to the President of the Supreme Court about the Luanda Court of Appeal's refusal to admit its appeal, so ordinary remedies had not been exhausted.
