The company GRANA PEDRA – Indústria de Pedras (SU), Lda. appealed to the Plenary against the President of the Court's order rejecting its ordinary appeal on grounds of unconstitutionality, filed by mistake instead of an extraordinary appeal, arguing that it should have been invited to correct it. The Court upheld the order, since the formal requirements of an ordinary appeal were not met and conversion would also fail because ordinary remedies had not been exhausted.
