Macon Transportes, Limitada lodged an extraordinary appeal on grounds of unconstitutionality against the order of the President of the Supreme Court dismissing its complaint in labour proceedings in which its appeal had been declared abandoned, invoking the principles of legality and effective judicial protection. The Court held that it lacked jurisdiction to hear the appeal because ordinary remedies had not been exhausted, as the first-instance judge had not ruled on the interlocutory appeal lodged.
