The appellant, a defendant in criminal proceedings, appealed against the order of the President of the Supreme Court upholding the rejection, as inadmissible by law, of his appeal from a Luanda Court of Appeal judgment, alleging breaches of the right of appeal, equality and fair trial. The Court dismissed the appeal because the order applied the law in force, he had already had one level of appeal and the Constitution gives the legislature latitude in shaping that right.
