A citizen lodged an extraordinary appeal on grounds of unconstitutionality against the Supreme Court judgment refusing his habeas corpus application, alleging breaches of the right to a fair trial, the presumption of innocence and pre-trial detention time limits, as he had not been notified of the indictment or committal order. The Court considered that the lack of notification was equivalent to the orders not having been issued but, as the appellant had been released, closed the proceedings as moot.
