Two citizens convicted at first instance and kept in custody lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment refusing habeas corpus, invoking the rights to liberty and to habeas corpus, the presumption of innocence and the accusatory principle. The Court dismissed the appeal as moot, since the Supreme Court had already decided the ordinary appeal and the pre-trial detention no longer existed.
