Grupo Caxombo, Limitada, brought an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment upholding a ruling based on its failure to file a defence, invoking the rights of defence and to a fair trial. The Court allowed the appeal: service had taken place during the judicial vacation, so the time limit only began on 1 March and the defence was filed in time. It ordered the defence to be admitted and subsequent acts annulled.
