Two defendants brought an extraordinary appeal on grounds of unconstitutionality against a judgment of the Criminal Chamber of the Supreme Court convicting them of fraud, invoking the rights of defence and to a fair trial. The Court allowed one appellant's appeal, declaring the judgment null as regards him because he had been convicted of a different offence on facts absent from the indictment and committal order, and dismissed the other appellant's appeal.
