The appellant, who had been dismissed on disciplinary grounds, lodged an extraordinary appeal on grounds of unconstitutionality against the judgment of the Labour Chamber of the Supreme Court upholding the dismissal of the case against her employer, CLIDOPA Angola, Lda. The Court allowed the appeal and declared the judgment unconstitutional because it had failed to rule on the alleged nullity of the dismissal and its consequences, in breach of the principle of legality and the right to effective judicial protection.
