Two citizens sentenced at first instance to 8 and 9 years' imprisonment for aggravated robbery, who had appealed with suspensive effect, challenged the Supreme Court judgment refusing them habeas corpus, alleging that their continued detention was unlawful. The Court dismissed the appeal, holding that the suspensive effect of an appeal does not entail the release of the defendants and that, since the time limits for indictment, committal and trial had been met, there was no unlawful detention.
