A citizen sentenced to seven years' imprisonment appealed against an order of the President of the Supreme Court summarily rejecting his complaint against the decision that declared his ordinary appeal abandoned because his pleadings were late, invoking effective judicial protection. The Court allowed the appeal and declared the decision unconstitutional, since the case file had been unavailable for consultation during the period for filing pleadings, which prevented the exercise of the right of defence.
