A defendant lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment refusing his habeas corpus application against the house arrest imposed on him as a more severe coercive measure. He invoked legality, equality and the right to effective judicial protection. The Court dismissed the appeal because the exhaustive legal grounds for habeas corpus were not met and different coercive measures for co-defendants do not breach equality.
