A citizen lodged an extraordinary appeal on grounds of unconstitutionality against an order of the Benguela Provincial Court which, in third-party joinder proceedings, refused as out of time her appeal to the Supreme Court; she alleged a breach of her property right over her share in the family home. The Court held that it lacked competence to hear the appeal because ordinary remedies, including the complaint provided for in the Code of Civil Procedure, had not first been exhausted.
