A citizen lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment which, partly reversing his acquittal at first instance, sentenced him to 10 years and six months' imprisonment for aggravated robbery and illegal possession of a firearm, invoking the right of defence and the presumption of innocence. In its reasoning, the Court found that the judgment breached the presumption of innocence by relying on presumptions rather than sufficient evidence.
