A citizen fined in summary proceedings lodged an extraordinary appeal on grounds of unconstitutionality directly against the Luanda Provincial Court's sentence, alleging he had only a court-appointed defender and invoking the rights of access to justice and to a fair trial. The Court found that he had been assisted by a court-appointed defender throughout and that the sentence could be appealed to the Supreme Court, so failure to exhaust ordinary remedies prevented review.
