The appellant, convicted at first instance and held in pre-trial detention pending his ordinary appeal, lodged an extraordinary appeal on grounds of unconstitutionality against a judgment of the Criminal Chamber of the Supreme Court refusing his habeas corpus application for excessive pre-trial detention, invoking the presumption of innocence. As the Supreme Court had meanwhile decided the ordinary appeal, the Court closed the proceedings as moot, since the conditions for habeas corpus no longer existed.
