A detained defendant lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment refusing his habeas corpus application, invoking the right to habeas corpus, the principle of legality and the right to a fair trial. As the appellant had been released because the maximum period of pre-trial detention had been exceeded, the Court held that the proceedings should be closed as moot.
