A citizen convicted of breach of trust lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment reducing his sentence from 8 to 6 years' imprisonment, alleging arrest without a warrant, insufficient evidence and breach of legality and effective judicial protection. The Court dismissed the appeal because the decision rested on concrete evidence, including a confession, the Court could not act as a third instance, and the appellant had freely exercised his right of appeal.
