The appellant, sentenced at first instance to 8 years and 6 months for intentional homicide, challenged the Supreme Court judgment increasing the sentence to 14 years, alleging reformatio in pejus and breaches of the adversarial principle and full defence. The Court found no reformatio in pejus, as the Public Prosecution Service had also appealed, but allowed the appeal because the appellant had not been notified of the request to increase the sentence so as to respond.
