Khyber Internacional, Lda. brought an extraordinary appeal on grounds of unconstitutionality against a judgment of the Civil, Administrative, Tax and Customs Chamber of the Supreme Court upholding the refusal of its interim application for provisional restitution of possession of a plot of land, invoking legality, effective judicial protection and the right to property. The Court dismissed the appeal because the length of proceedings had not impaired effective protection and the measure concerned possession, not ownership.
