Robert Hudson, Lda lodged an extraordinary appeal on grounds of unconstitutionality against the judgment of the Labour Chamber of the Supreme Court ordering it to reinstate three workers and pay their back wages because they had been summoned to the disciplinary hearing with less than five days' notice. The Court dismissed the appeal, holding that the Supreme Court's interpretation, based on subsidiary legislation, safeguards the right of defence and does not breach legality, legal certainty or the right to a fair trial.
