The appellant brought an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment refusing his habeas corpus application, alleging that he had been arrested outside the act of committing an offence without proper reasons, in breach of the principle of legality. The Court declared the proceedings closed as devoid of purpose, because the appellant had already been tried and convicted and should challenge that decision by ordinary appeal, habeas corpus not being a means to discuss the merits.
