A citizen convicted of robbery lodged an extraordinary appeal on grounds of unconstitutionality against the Supreme Court judgment increasing his sentence to 18 years' imprisonment, invoking the presumption of innocence, legality, the nullity of a confession obtained under duress and the prohibition of reformatio in pejus. The Court dismissed the appeal, as the evidence was reasoned, it could not reassess facts, and the prosecution's mandatory appeal allowed the sentence to be increased.
