A citizen convicted in summary criminal proceedings lodged an extraordinary appeal on grounds of unconstitutionality against a Luanda Provincial Court order refusing to admit his ordinary appeal under Article 648 of the Code of Criminal Procedure, which he claimed breached the rights of appeal, effective judicial protection and defence. The Court dismissed the proceedings for lack of jurisdiction because ordinary remedies had not been exhausted, no complaint having been made to the President of the Supreme Court.
