A citizen sentenced by the Plenary of the Supreme Court to 8 years' imprisonment appealed against the judgment refusing him habeas corpus, arguing that, having lodged an extraordinary appeal on grounds of unconstitutionality, his conviction was not final and he remained in pre-trial detention beyond the legal limit. The Court dismissed the appeal, holding that the extraordinary appeal has non-suspensive effect and that, finally convicted, he was no longer in pre-trial detention, so liberty was not infringed.
