The appellant, sentenced to four years and six months' imprisonment, lodged an extraordinary appeal on grounds of unconstitutionality against the Supreme Court judgment upholding his conviction, alleging that his immediate imprisonment, before the time limit for this appeal had expired, was unlawful and that the adversarial principle, legality and the presumption of innocence were breached. The Court dismissed the appeal: he had already been released, he had confessed to the offence, and reassessing evidence was outside its jurisdiction.
