A citizen acquitted at first instance and later convicted by the Supreme Court, on appeal by the Public Prosecution Service, of a sexual offence against a child lodged an extraordinary appeal on grounds of unconstitutionality, alleging breach of the presumption of innocence and the in dubio pro reo principle. The Court dismissed the appeal, since the Supreme Court's conviction was based on the evidence in the file, without doubt as to the facts, and the appellant's rights of defence and to be heard had been ensured.
