Two citizens sentenced to three years' imprisonment lodged an extraordinary appeal on grounds of unconstitutionality against a judgment of the Common Crimes Division of the Luanda Provincial Court, invoking breach of the right to a fair trial and of the adversarial principle in framing the questions of fact. The Court concluded that it lacked jurisdiction to hear the appeal because ordinary remedies had not been exhausted, an appeal lying first to the Supreme Court.
