Two workers lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment upholding the acquittal of their employer, decided by summary judgment without a trial hearing or hearing of the witnesses listed. In its reasoning, the Court found a breach of the principles of a fair trial and of access to justice and effective judicial protection, and held that the case should return to the Supreme Court for its decision to be revised.
