A defendant convicted at first instance lodged an extraordinary appeal on grounds of unconstitutionality against the Supreme Court judgment rejecting his habeas corpus application as moot, alleging excessive pre-trial detention because no indictment was brought within the legal time limit. The Court concluded that the judgment breached the right to liberty and the habeas corpus guarantee, as the time limits had been exceeded before conviction, and ordered the appellant's immediate release.
