The appellant, convicted of embezzlement and held in pre-trial detention for 28 months pending an appeal with suspensive effect, brought an extraordinary appeal on grounds of unconstitutionality against a judgment of the Criminal Chamber of the Supreme Court refusing her habeas corpus application, invoking liberty and the presumption of innocence. In its reasoning, the Court allowed the appeal as the 18-month maximum without a final conviction had been exceeded.
