Banco de Comércio e Indústria (BCI) lodged an extraordinary appeal on grounds of unconstitutionality against a Supreme Court judgment upholding its defeat in a civil action brought by PRAXIS Gestão Imobiliária, alleging defective service because the summons was handed to an employee, and breaches of legality, equality, the right of defence and fair trial. The Court dismissed the appeal, since the bank had been properly served and, having filed no defence, the facts were lawfully deemed admitted.
