Following a disciplinary dismissal by SOGESTER – Sociedade Gestora de Terminais, S.A., the appellant lodged an extraordinary appeal on grounds of unconstitutionality against the Supreme Court Labour Chamber judgment upholding just cause, invoking the principles of adversarial proceedings, full defence, equality and the prohibition of dismissal without just cause. The Court dismissed the appeal, since it sought a review of the merits and evidence, which is not the Court's role, and the alleged unconstitutionalities were not established.
