The appellant lodged an extraordinary appeal on grounds of unconstitutionality against the judgment of the Plenary and Appeal Court of the Supreme Court upholding the dismissal of her administrative action against a decision of the National Social Security Institute on the amount of her pension, on the grounds of incompatible joined claims. The Court allowed the appeal, holding that the court should have ruled on the claim for annulment of the decision and that the dismissal breached the right of access to justice and effective judicial protection.
