A citizen convicted of embezzlement, whose sentence the Supreme Court had reduced, lodged an extraordinary appeal on grounds of unconstitutionality against that judgment, invoking the presumption of innocence, the rights of defence and appeal, the inviolability of correspondence and communications and the accusatorial and legality principles. The Court dismissed the appeal, finding that the conviction, for the same offence as charged, was reasoned in fact and law and that it may not review the legal classification of the facts.
