Three defendants lodged an extraordinary appeal on grounds of unconstitutionality against the order of the President of the Luanda Court of Appeal refusing habeas corpus, alleging excessive pre-trial detention because the indictment had been issued after the four-month limit. The Court dismissed the appeal, since the appellants had already been tried and convicted at first instance within the maximum legal period, so the requirement that the unlawful detention be current, needed for habeas corpus, was not met.
