The appellant, convicted of negligent offences arising from a road accident that caused the death of a driver, lodged an extraordinary appeal on grounds of unconstitutionality against the judgment of the Criminal Chamber of the Luanda Court of Appeal refusing to suspend his prison sentence, invoking the principle of proportionality. The Court dismissed the appeal, holding that the judgment under appeal had given adequate reasons for its unfavourable social prognosis and had not breached the prohibition of excess.
